📖｜簡介｜
台灣是亞洲最具活力的民主社會之一，在全球政治權利與公民自由的評比中持續名列前茅。然而，儘管台灣擁有堅實的民主基礎並致力於保障人權，卻仍缺乏一個完善的難民保護法律框架。雖然過去二十年來不斷提出難民法草案，但始終未能完成立法。學者與決策者指出了造成此立法僵局的幾個原因，包括台灣被排除在聯合國與 1951 年《難民地位公約》之外、與兩岸移民相關的國家安全疑慮，以及台灣獨特的政治與憲政處境。然而，這些解釋主要著眼於法律與制度上的限制。
有別於以往從法律層面探討，本次演講將把焦點轉向另一個關鍵變項「台灣民意」。台灣民眾如何看待難民以及建立正式庇護機制的可能性？人道價值、國家認同、安全疑慮與政治考量，在多大程度上形塑了公眾對難民保護的態度？透過探討這些問題，本次演講將為台灣通過難民法的社會與政治可行性提供全新的見解。

📄 Abstract
Taiwan is one of the most vibrant democratic societies in Asia, consistently ranking highly in global measures of political rights and civil liberties. Yet, despite its strong democratic credentials and commitment to human rights, Taiwan continues to lack a comprehensive legal framework for refugee protection. Although draft refugee legislation has been proposed repeatedly over the past two decades, it has never been enacted. Scholars and policymakers have identified several reasons for this legislative impasse, including Taiwan’s exclusion from the United Nations and the 1951 Refugee Convention, national security concerns related to cross-Strait migration, and the island’s unique political and constitutional circumstances. However, these explanations focus primarily on legal and institutional constraints.
Moving beyond previous legal perspectives, this talk turns attention to another crucial dimension: “Taiwanese public opinion.” How do people in Taiwan perceive refugees and the possibility of establishing a formal asylum mechanism? To what extent do humanitarian values, national identity, security concerns, and political considerations shape public attitudes toward refugee protection? By examining these questions, the talk offers new insights into the social and political feasibility of adopting a refugee law in Taiwan.
